Heavendesk End-User Licence Agreement (EULA)

1. Who this agreement is with
This End-User Licence Agreement ("EULA") is a legal agreement between you ("you", "the User") and:

referred to below as "we", "us", "the Licensor".
This EULA governs the Heavendesk software that you install and run on your own hardware. The online parts of Heavendesk (the website, the account system, the broker and the relay) are governed separately by the Terms of Service and Terms of Sale, and personal data is covered by the Privacy Policy. Where this EULA and the Terms of Service overlap, this EULA governs the software itself and the Terms of Service govern everything else.
2. Acceptance
You accept this EULA by installing, copying, or running the Software, or by clicking an acceptance control presented during installation, purchase, or first launch. If you do not accept it, do not install or use the Software, and remove any copy you have already installed.
If you are accepting on behalf of a company or other organisation, you confirm you are authorised to bind that organisation, and "you" then means that organisation.
3. Definitions
- Software means the Heavendesk programs distributed by us, including the
Heavendesk server (
heavendesk-server), the Heavendesk client applications, their command-line tools, configuration files, packaging, updates and documentation. - Service means the online components operated by us: the website at heavendesk.com, the account system, the connection broker, and the fallback relay.
- Account means your Heavendesk account, created on the website.
- Entitlement means the limits attached to your Account (maximum resolution, maximum frame rate, maximum number of enrolled devices), as determined by your plan.
- Free Tier means use of the Software at the default entitlement without any paid plan, as described in section 5.
- Host means a machine running the Heavendesk server, whose screen, audio and input are shared.
- Device means a machine enrolled against your Account, whether acting as a Host or as a client.
4. Licence grant
Subject to your compliance with this EULA, we grant you a non-exclusive, non-transferable, non-sublicensable, revocable licence to:
a. install and run the Software on Devices that you own or otherwise lawfully control, in a number consistent with your Entitlement; b. use the Software for your own personal purposes or for the internal business purposes of your organisation; c. make copies of the Software strictly as needed for installation and backup.
This is a licence, not a sale. You acquire no ownership of the Software. All rights not expressly granted here are reserved.
Where a paid plan applies, the licence in this section is granted for the duration of that plan and depends on the fees for it having been paid.
5. Free Tier
The Software can be installed and used without payment at the default entitlement:
- maximum stream resolution 1920x1080,
- maximum frame rate 30 fps,
- up to 2 enrolled devices.
The Free Tier exists so that you can evaluate Heavendesk on your own hardware before paying for anything. It is provided free of charge and "AS IS" on the terms of section 11, and we may change its limits, suspend it, or withdraw it at any time. Nothing in the Free Tier creates an obligation on us to keep it available, to keep any particular limit, or to provide support.
An Account that has no plan, whose plan has been cancelled, whose subscription is no longer in good standing, or whose entitlement cannot be determined, falls back to exactly these Free Tier limits. It does not lose access to the Software.
While a beta is running (section 5a of the Terms of Service), your Account may be given higher limits than these, free of charge and "AS IS" on the same terms as the Free Tier. We may change those limits or end the beta at any time. When it ends, your Account returns to the Free Tier limits above, or to your plan's limits if you have a paid plan and they are higher. Everything this section says about changing, suspending or withdrawing the Free Tier applies equally to the beta.
6. Entitlement enforcement
Your Entitlement is determined by us from our own records and delivered to your Devices as a short-lived, cryptographically signed session capability. The Software applies those limits locally.
We state this plainly rather than implying more than is true: the resolution and frame-rate limits are enforced by software running on your own machine. They are product enforcement, not a security boundary. This does not entitle you to defeat them, and doing so is a breach of section 7 whether or not it is technically possible.
The Software contains no analytics or usage reporting that you have not switched on. Out of the box it contacts our infrastructure only to authenticate your Account, to enrol or resolve Devices, to obtain a session capability, and to set up connections. The optional diagnostics report described in section 4.8 of the Privacy Policy is off unless you enable it, carries no Account link and nothing from your sessions, and can be switched off again at any time.
7. Restrictions
You must not, and must not permit anyone else to:
a. copy, distribute, sell, rent, lease, lend, host as a service, or otherwise make the Software available to third parties, except as expressly permitted here; b. modify, adapt, translate or create derivative works of the Software, or merge it into another program; c. reverse engineer, decompile or disassemble the Software, except to the extent that such acts cannot lawfully be restricted, including the rights granted by Articles 5 and 6 of Directive 2009/24/EC and Articles 74 to 75 of the Polish Act of 4 February 1994 on Copyright and Related Rights; d. remove, obscure or alter any copyright, trademark or licence notice; e. circumvent, disable or tamper with the entitlement checks, the signed session capability, the device enrolment mechanism, or any other licence enforcement, or use the Software with a capability you were not issued; f. share Account credentials or device tokens in order to exceed your Entitlement, or to give access to people outside your household or organisation; g. use the Software to access, view, control or inject input into any machine you are not authorised to control; h. use the Software to break the law, infringe anyone's rights, or intercept or monitor a person without a lawful basis for doing so; i. attack, overload, probe or attempt to gain unauthorised access to the broker, the relay, the website, or any other user's Devices; j. use the relay to carry traffic unrelated to your own Heavendesk sessions.
Items b and c do not apply to the libraries that come with the Software under the GNU Lesser General Public License (listed in the third-party notices). You may replace any of them with a modified version for your own use, and modify and reverse engineer the Software to the extent necessary to debug such a replacement. We do not support installations in which they have been replaced.
8. Your responsibilities as an operator
The Heavendesk server gives a remote party the ability to see your screen, hear your audio and inject keyboard and mouse input into your session. That is the product working correctly. You are responsible for:
- deciding which machines run it and who may connect to them;
- keeping your Account credentials, device tokens and host machines secure;
- revoking devices you no longer control;
- complying with any workplace, contractual or legal rules that apply to remote access on the machines you use it on;
- informing anyone else who uses a machine you have made remotely accessible;
- your own backups. The Software is not a backup product and gives no protection against data loss.
9. Updates
We may make updates, fixes and new versions available through our package repositories or the website. Updates are governed by this EULA unless a different licence is supplied with them.
We may change, add or remove features, including features you rely on. Where we provide the Software or a plan to you as a consumer, we will notify you of changes that materially and negatively affect access to or use of the Software, and you may terminate as described in the Terms of Service.
We do not undertake to provide updates indefinitely, to support older versions, or to keep any published package repository online.
10. Third-party and open-source components
The Software uses, links against, or is distributed alongside third-party components, including FFmpeg (libavcodec, libavutil, libavfilter, libswscale), Qt, libsodium, Opus, OpenSSL, and, on NVIDIA systems, NVIDIA's CUDA and video encoding libraries. On Linux most of these are supplied by your distribution rather than by us, while FFmpeg and NVIDIA's CUDA runtime are shipped with Heavendesk; on Windows they are shipped with the installer.
Each such component remains subject to its own licence. Where a component's licence grants you rights broader than this EULA, that licence prevails for that component, and nothing in this EULA is intended to restrict rights you have under a free or open-source licence. The components, their licences and the full licence texts are listed in the third-party notices that are installed with every copy of the Software, and can be opened from Heavendesk's About page. They also say how to obtain the source code of the libraries licensed under the GNU Lesser General Public License.
10a. OpenH264 (Cisco Systems, Inc.)
The Software can use OpenH264, a software H.264 video codec published by Cisco Systems, Inc., when your machine has no hardware video encoder.
The OpenH264 binary is not distributed by us and is not bundled with the Software. It is downloaded directly from Cisco to your device when Heavendesk is installed. If that download does not happen — you are offline, your network blocks it, or you decline — the Software works normally and software H.264 is simply unavailable.
You can turn it off. Settings → Video → "Allow the OpenH264 video codec" enables, disables and re-enables its use at any time.

About the Cisco-Provided Binary of OpenH264 Video Codec
Cisco provides this program under the terms of the BSD license.
Additionally, this binary is licensed under Cisco's AVC/H.264 Patent Portfolio License from MPEG LA, at no cost to you, provided that the requirements and conditions shown below in the AVC/H.264 Patent Portfolio sections are met.
As with all AVC/H.264 codecs, you may also obtain your own patent license from MPEG LA or from the individual patent owners, or proceed at your own risk. Your rights from Cisco under the BSD license are not affected by this choice.

AVC/H.264 Patent Portfolio License Conditions
In addition, the Cisco-provided binary of this Software is licensed under Cisco's license from MPEG LA only if the following conditions are met:
The Cisco-provided binary is separately downloaded to an end user's device, and not integrated into or combined with third party software prior to being downloaded to the end user's device;
The end user must have the ability to control (e.g., to enable, disable, or re-enable) the use of the Cisco-provided binary;
Third party software, in the location where end users can control the use of the Cisco-provided binary, must display the following text:
"OpenH264 Video Codec provided by Cisco Systems, Inc."
Any third-party software that makes use of the Cisco-provided binary must reproduce all of the above text, as well as this last condition, in the EULA and/or in another location where licensing information is to be presented to the end user.
11. NO WARRANTY: the Software is provided "AS IS"
THE SOFTWARE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. To the maximum extent permitted by applicable law, we disclaim all warranties and conditions, including any implied warranty of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement.
In particular, and without limiting the above, we do not warrant that:
- the Software will run at all on your hardware, your graphics driver, your kernel, your distribution, your compositor or your display configuration;
- capture, hardware encoding, audio, input injection, cursor rendering, multi-monitor handling or NAT traversal will work on any given system;
- the Software will be uninterrupted, timely, secure, error-free, or free of latency, stutter, dropped frames, colour inaccuracy or disconnections;
- defects will be corrected, or corrected within any particular time;
- the Software is compatible with any hardware or software not listed in Annex A.
Heavendesk is developed and tested on a small number of specific machines. The configurations it has actually been exercised on are listed in Annex A, with the date of that testing. Any configuration not listed in Annex A is untested. The Linux graphics stack varies enormously between vendors, drivers, kernels and desktop environments, and a change in any one of them can stop Heavendesk working on a machine where it worked the day before. You accept this before you install it. The Free Tier exists precisely so that you can verify the Software works on your own hardware before paying.
Nothing in this section limits or excludes:
- our liability for damage caused intentionally, which cannot be excluded under Article 473 § 2 of the Polish Civil Code;
- your statutory rights as a consumer, including the rights concerning conformity of digital content and digital services under the Polish Act of 30 May 2014 on Consumer Rights, as amended;
- any other liability that cannot lawfully be excluded or limited.
If you are a consumer, the disclaimers above apply only to the extent Polish law allows them to, and your statutory rights are unaffected. The complaints procedure is set out in the Terms of Service.
12. Not for high-risk use
The Software is not designed, tested or intended for use in any environment where failure, delay, loss of input or loss of picture could lead to death, personal injury, or severe physical, environmental or financial damage. This includes medical use, aviation, vehicle control, industrial control systems, life support, weapons systems, and emergency or safety-critical operations. You must not use it for such purposes, and we accept no liability if you do.
13. Limitation of liability
To the maximum extent permitted by applicable law:
a. we are not liable for indirect or consequential loss, loss of profit, loss of revenue, loss of business, loss of goodwill, loss of anticipated savings, downtime, loss or corruption of data, or the cost of substitute software or services; b. our total aggregate liability arising out of or in connection with the Software, on any basis, is limited to the total amount you actually paid us for Heavendesk in the twelve (12) months preceding the event giving rise to the claim; c. where you use the Software under the Free Tier or during a beta, and so have paid us nothing, our total aggregate liability is limited to EUR 0, to the extent the law permits a limitation at that level.
Sections 13(a) to 13(c) do not apply to liability for damage caused intentionally, for death or personal injury caused by our negligence, or to any other liability that cannot lawfully be limited. If you are a consumer, they apply only so far as Polish law allows.
14. Term and termination
This EULA applies from the moment you first install or run the Software and continues until terminated.
You may terminate at any time by uninstalling the Software and deleting all copies.
We may terminate this EULA with immediate effect if you materially breach it, in particular section 7. On termination you must stop using the Software and remove all copies. Termination of this EULA does not by itself refund any fees; refunds are dealt with in the Terms of Service.
Sections 6, 7, 10, 11, 12, 13, 15 and 16 survive termination.
15. Governing law
This EULA is governed by Polish law. If you are a consumer resident in the European Union, this choice does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence.
16. General
Assignment. You may not assign or transfer this EULA. We may assign it as part of a transfer of the Heavendesk business, without reducing your rights.
Severability. If any provision is held unenforceable, the rest remains in force and the unenforceable provision is replaced by the enforceable provision closest to its intent.
No waiver. A failure to enforce a provision is not a waiver of it.
Language. The English version is the reference version.

Annex A: Tested configurations
Accurate as of 26 August 2026, except that the Windows machine rows, the Windows assumptions and the Windows lines under "Not tested and not released" were updated on 20 September 2026. This annex records the hardware and software Heavendesk has actually been run on. It is not a compatibility list and it is not a promise. It exists so you know exactly how narrow the testing is.

What the Software assumes
On Linux:
- Linux, with systemd.
- Direct access to the KMS/DRM scanout for screen capture.
- A KDE Plasma 6 Wayland session. Display layout is probed with KDE tooling, so other desktop environments have not been exercised.
- A hardware video encoder (NVENC or VAAPI) for acceptable performance. Software encoding works but costs a great deal of CPU.
On Windows:
- 64-bit Windows 10 version 1803 or later, or Windows 11.
- Desktop Duplication, which requires a display that is powered on. A machine whose display has gone to sleep refuses capture with an access-denied error.
- A hardware video encoder for acceptable performance. Intel Quick Sync (H.264) and NVIDIA NVENC (HEVC) have been tested; AMD AMF has not. Software encoding works and costs a great deal of CPU.
- Administrator rights at install time, to register the service. The service runs as the local system account, which is what allows it to reach the sign-in and lock screens; no lesser account can do this.
- The Windows installer is not code signed. SmartScreen warns on first run. A SHA-256 checksum is published beside the download.
Not tested and not released
- macOS hosts and macOS clients. Both are planned, neither is released, and the download page marks them as future.
- Windows hosts on AMD graphics. That encode path (AMF) is built and shipped but has never been run. Windows on NVIDIA graphics has been run only in the virtual machine described above, not on a bare-metal install.
- Windows audio playback on a bare-metal machine. A Windows client has played streamed audio only on the virtual machine described above, through a virtual sound card routed to the host machine's speakers.
- Windows as an upgrade over a previous Windows installation, other than on the virtual machine described above, where upgrades over earlier builds have been exercised.
- X11 sessions, and desktop environments other than KDE Plasma 6.
- Hybrid or multi-GPU laptops, and virtual machines or GPU passthrough guests other than the single Windows guest recorded above.
- HDR, resolutions and refresh rates above those listed above, and display configurations other than the ones tested.
- Any hardware not named in this annex.
If your machine is not listed here, install the Free Tier and confirm Heavendesk works on it before you pay for anything.
